Die letzten Wahlen oberster staatlicher Organe in der DVRK (also die Wahlen zur Obersten Volksversammlung, zu den Provinz-, Bezirks- und Gemeindeversammlungen; alle 4 Organe wurden letztes Mal am gleichen Tag gewählt) fanden nach nordkoreanischen Berichten am 3. August 2003 statt.

Dieselbe Quelle sagt, dass laut der Verfassung der DVRKorea die Vertreter der Obersten Volksversammlung alle 5 Jahre, die Vertreter der lokalen Volksversammlung alle vier Jahre gewählt werden müssen.

Wurden nun tatsächlich vergangenes Jahr Lokalwahlen und dieses Jahr allgemeine Wahlen zur Obersten Volksversammlung abgehalten oder werden die erst in kürze stattfinden !?

Weder in nordkoreanischen noch ausländischen Presseberichten konnte ich irgendeine Meldung zu diesen (von der nordkoreanischen Verfassung her vorgesehenen) Wahlen finden ?

Falls die Wahlen tatsächlich noch nicht stattfanden, wie wurde das Problem der Überschreitung der verfassungsmäßigen Legislaturperiode legistisch gelöst ?
...meines Wissens haben die Wahlen bereits stattgefunden, die Kommunalwahlen sicher. Es sollte sich im Archiv der KCNA etwas finden, denn m.E. wurde dort u.a. auch über die Vorbereitungen (Einrichtung der entsprechenden Kommissionen zur Durchführung) berichtet. Evt. komme ich in den nächsten Tagen dazu, mir zwecks Suche etwas Zeit zu nehmen - im Augenblick fehlt mir diese etwas. Entscheidend ist v.a. wer sich bei der Nominierung als Kandidat oder Kandidatin durchsetzt. Von den allg. Wahlterminen abgesehen können die Abgeordneten des jeweiligen Wahlkreises von den Wahlberechtigten des Kreises jederzeit abgewählt werden - in diesem Fall müßte dort extra gewählt werden. Allerdings weiß ich nicht, ob das schon einmal passiert ist. In den Gewerkschaften werden die Leitungen ebenfalls gewählt.

Results of Election of Deputies to Local Power Bodies Released

Pyongyang, July 30 (KCNA) -- The Central Election Guidance Committee for the Election of Deputies to the Provincial (Municipality Directly under Central Authority), City (District) and County People's Assemblies of the DPRK issued a report on the results of the election on July 30.
The election was successfully carried out at all constituencies across the country in accordance with the law on election of deputies to people's assemblies at all levels on July 29, according to the report.
The report says:
According to the information available from the provincial (municipality directly under central authority), city (district) and county election committees, 99.82 percent of all the voters registered on the list of voters participated in voting and 100 percent of them voted for the candidates for deputies to the provincial (municipality directly under central authority), city (district) and county people's assemblies registered at all the constituencies.
Those who are staying in foreign countries or those who are working in seas far away from the land could not take part in the election.
27,390 officials, workers, farmers and intellectuals were elected deputies to the provincial (municipality directly under central authority), city (district) and county people's assemblies.
The election of deputies to the local power bodies marked an important occasion in reinforcing as firm as a rock the revolutionary government of the DPRK led by Kim Jong Il and further increasing the function and role of the people's power by electing persons of ability, who have devotedly worked for the Party and the leader, the country and the people, to the local power bodies.

Was ich auch damals komisch fand, zur Zeit der Wahlerfassung waren es 100%
Die Wahlerfassung fand aber vor der Wahl statt.
Zum Zeitpunkt der Wahl waren also wahlberechtigte Personen verstorben.
Die Anzahl der Verstorbenen war aber höher als 0.18 %.
Ein paar Leute konnten, oder wollten auch nicht zur Wahl gehen.
In der DDR wurde dann immer vom gemeinen Volk gelästert, das wir wieder eine Wahlbeteiligung von etwa 115% hätten.
Kann SecGermany das bitte erklären?
Die Wahlen zur Obersten Volksversammlung der DVR-Korea sollten am 5. August 2008 stattgefunden haben. Ob das so war oder nicht, ist nicht bekannt:

Die Wahlen zur Obersten Volksversammlung der DVRK (quasi dem nordkoreanischen Parlament) sollen, nachdem sie entgegen der nordkoreanischen Verfassung ohne Angabe von Gründen im August 2008 nicht stattfanden, nun im März 2009 nachgeholt werden, meldete die südkoreanische Nachrichtenagentur heute (die sich dabei auf Informationen aus dem Norden bezieht):

SEOUL, Jan. 7 (Yonhap) -- North Korea will hold parliamentary elections in March, Pyongyang's news agency said Wednesday, a sign of the regime returning to normal with leader Kim Jong-il's improving health.
The Supreme People's Assembly made its decision on Tuesday to "hold the 12th representatives' election on March 8 in 2009," the Korean Central News Agency said in a brief statement.
North Korea missed the elections expected in August or September of 2008, when the assembly members' five-year term expired. Seoul and Washington officials say Kim suffered a stroke in mid-August.
Analysts view the notice as a sign that Kim has recovered enough to appear in public. Recent North Korean media reports suggested a growing ease in his body movement as he briskly toured industrial and military sites. In images released on Monday, Kim was clapping with his two bare hands, compared to previous photos in which he applauded with gloves on or had his left hand resting inside his pocket or drooping at his side.
"With the election notice, North Korea is normalizing its political schedule, based on a judgment that Chairman Kim's health has recovered to some degree," Yang Moo-jin, a professor of the University of North Korean Studies in Seoul, said.

Citizens vote in the direct election according to the North's Constitution, but the appointees are initially the government's picks. The current 687 representatives were elected in 2003.
Habe nun auch die Ankündigung zur Wahl 2009 in der Choson Sinbo gefunden (leider nur auf koreanisch):

최고인민회의 제12기 대의원선거 3월 8일에 실시

7일발 조선중앙통신에 의하면 조선민주주의인민공화국 최고인민회의 대의원선거를 실시함에 대한 최고인민회의 상임위원회 결정이 6일에 발표되였다.
그에 의하면 조선민주주의인민공화국 사회주의헌법 제90조에 따라 최고인민회의 제12기 대의원선거를 주체98(2009)년 3월 8일에 실시한다.

Abhaltung der Wahlen zur 12. Periode der Obersten Volksversammlung am 8. März

Am 7. Jänner berichtete die Zentrale Nachrichtenagentur Koreas, dass der Ständige Ausschuss der Obersten Volksversammlung am 6.1. den Beschluss zur Abhaltung der Wahlen zur Obersten Volksversammlung der DVRK veröffentlicht habe.
Demnach soll in Übereinstimmung mit Artikel 90 der sozialistischen Verfassung der DVRK die 12. Oberste Volksversammlung am 8. März Juche 98 (2009) gewählt werden.

Was steht also im Artikel 90 der nordkoreanischen Verfassung ?

Artikel 90
Die Legislaturperiode der Obersten Volksversammlung beträgt fünf Jahre.
Neuwahlen zur Obersten Volksversammlung finden vor Ablauf der Legislaturperiode der Obersten Volksversammlung auf Beschluß des Ständigen Komitees der Obersten Volksversammlung statt.
Wenn auf Grund besonderer Umstände die Wahl nicht durchgeführt werden kann, wird die Legislaturperiode bis zur Wahl verlängert.

Interessant ist, dass die Verfassung nicht weiter erklärt, was alles als "besonderen Umstände" angesehen werden kann. Wie praktisch !

Superior Election System of DPRK

Pyongyang, February 13, 2009 (KCNA) -- The election of deputies to the 12th Supreme People's Assembly is to be held in the DPRK on March 8.

This election system in the DPRK makes it possible for the working people to truly participate in the formation of the state power.

The superiority of the election system finds manifestation in that the election is held in a free and fair atmosphere by secret vote on the principles of general, equal and direct election.

On the principle of general election, all the citizens above the age of 17 can take part in the elections of deputies to the people's assemblies at all levels and be elected, irrespective of sex, nationality, occupation, period of residence, property status, standards of learning, party affiliation, political view and religious belief. Only those who are deprived of the right to election by the decision of a court and mentally deranged persons are denied the right to elect and be elected.

The principle of equal voting enables all the voters to elect and be elected with the same qualification and right. It allows no difference in the weight and efficiency of the ballot.

On the principle of direct election, the voter casts his or her ballot directly to a candidate for deputy. It, unlike indirect voting, makes it possible to convey the will of the voters directly to the deputies to make the people's power bodies democratic power bodies representing the will of all the voters.

This principle is guaranteed by practical measures such as strictly banning voting by proxy, installing special sub-constituencies at hospitals, sanatoria, major railway stations and other places, organizing itinerant voting for citizens unable to come to the voting booths and declaring the election day a holiday.

Secret ballot enables the voters to express their free will on the candidates without any restriction. It guarantees a fair and aboveboard election by letting every voter express his or her will freely without subject to coercion, surveillance or threat by anyone.

These principles of election in the DPRK are ones embodying socialist democracy, democracy of the highest form, which make it possible to firmly build up the power bodies at all levels with fine representatives of the working class and working people of other strata, make the power bodies direct spokespersons of the will of the popular masses and stand the popular masses as the genuine masters of power.

Now the entire army and people are full of enthusiasm to powerfully demonstrate once again the might of single-minded unity in the DPRK and fortify the people's power like a monolith by taking part in the election as one man.
